For many years I have held a rather heretical (in the usual lefty point of view) opinion. I personally believe that we are living in a post capitalist society that is better described as "managerial" rather than "capitalist". This is, of course, a moot point, and I recognize that no society is purely dependent on only one mode of production and exchange. The inclusion of exchange is important to differentiate my point of view from merely another 'historical materialist' point of view, one that is solely focused on prouction and neglects to one degree or another the world of consumption.

I'll leave the justification of this opinion for another time.What is important here is just like an idealized "capitalist" society has its periodic crises somehow connected to "overproduction" so does managerial society has its own cycles.of crisis. The business cycle, of course, never followed the rule book laid out by Marx in Capital ?. When Marx wrote his magnum opus in the most free trade society? in the world at the time of its maximum free trade existence ie its closest approach to an ideal "capitalism" it was at least seeminly possible that history would follow the schemata that Marx laid out.

There was, however, a fly in the soup.History didn't march to a Marxist drumbeat. This was amptly demonstartrated by Eduard Bernstein in the early years of the 20th century (?see Evolutionary Socialism ). The proletariat was not forced into increasing poverty. So-call "intermediate strata' did not disappear and instead multiplied. The force of monopoly went so far and then settled into a dynamic balanceas new economic opportunities opened up. The Leninist incantations of ?mperialism`failed to explain the fact that the workers found? that they could improve their position by both trade union and political ways.The marxist left was left with a theory of price that always failed to either predict or explain the cost that a commodity fetched on the market (free, semi-free or stateized).

In the end there was a business cycle that was more of less controlled (abolished?? ) by state management- both the authoritarian communist and the Keynesian methods. What was left was a society that continued to have periodic crises. Only some of these were classically economic. Others were very much social/political as various underclasses would rebel against their managerial overlords. Of course the eruptions of such rebellion was not wholly predictable, but I seemed to have found a least a crude periodicity of such rebellions in both the so-called capitalist world and in the state socialist world as well. The period was anywhere from 7 to 10 years, and it would often be demonstarted in the state socialist societies not as open rebellion but rather as economic crises, presumably due to somewhat "passive rebellion" on the part of workers and consumers.

Thyere was also the fact that no economic system in history has been pure. The state socialist societies existed only because of an underground capitalist black market that made said societies livable. Feudalism contained elements of both capitalism (the merchants) and managerial rule (many of the monastic orders). Our present society wavers between a managerial system and a capitalist one with the caveat that the decision to adapt prouction and consumption to the rules of the market lies with managers, especially those of the state, the managerial class par excellance.

Moffitt Researchers find genetic predictors of fatigue for some ...

Researchers at Moffitt Cancer Center and the University of South Florida have found that men with prostate cancer who receive androgen deprivation therapy may predictably suffer from fatigue if they have single nucleotide polymorphisms in three pro-inflammatory genes. The discovery highlights the importance of personalized medicine, in which therapies are tailored to a patient's genetic profile.

The study appears in the October issue of Brain, Behavior, and Immunity.

"Few studies have examined the role of genes in cancer-related fatigue and none, to our knowledge, have examined genetic variation related to androgen deprivation therapy," said study co-principal investigator Heather S.L. Jim, Ph.D., assistant member of the Health Outcomes and Behavior Program. "We found that prostate cancer patients who carry the variants of the IL6 and TNFA genes and are treated with androgen deprivation therapy are susceptible to heightened fatigue."

Evidence from prostate cancer studies suggests that pro-inflammatory cytokines, which have been linked to fatigue in cancer patients, are influenced by testosterone. At the same time, testosterone inhibits IL6 gene expression. Androgen deprivation therapy restricts testosterone.

"The goal of our study was to examine whether single nucleotide polymorphisms in genes that regulate pro-inflammatory cytokines can predict changes in fatigue in men receiving androgen deprivation therapy," said co-principal investigator Paul B. Jacobsen, Ph.D., associate center director for Cancer Prevention & Control at Moffitt. "We hypothesized that patients displaying variants at these sites would display greater increases in fatigue following initiation of androgen deprivation therapy."

The researchers found that patients with a greater number of variants reported greater increases in fatigue and of longer duration.

"It is still unclear why IL6 and TNFA genotypes affected some aspects of fatigue but not others," Jim said. "While the single nucleotide polymorphisms found in our study were located in predicted transcription factor binding sites that regulate gene expression, a single gene can have many regulatory sites scattered across the genome."

The authors speculated that new single nucleotide polymorphisms may be uncovered that will help to clarify the mechanisms of inflammatory gene transcription as they relate to fatigue in cancer patients. Preliminary findings from this study "represent an important first step in identifying genetic variation as a predictor of fatigue secondary to androgen deprivation therapy," the researchers concluded.

"Early identification of patients with genetic risk factors can enable clinicians to provide timely interventions, behavioral or pharmacologic, to prevent or reduce fatigue," Jacobsen said. "This goal is consistent with personalized cancer treatment tailored to individual gene profiles to maximize benefit and minimize side effects."

As the NFL launches its annual exportation of American football, it?s important for everyone to sell the product to a growing European audience.

Pats coach Bill Belichick didn?t get the memo.? Or, if he did, he tore it up.? Or ignored it.? Or both.

In his first meeting with the media in London since his team played there three years ago, Belichick displayed his usual bad ventriloquist routine, saying as little as possible behind a mouth that was barely moving.

Belichick is one of the all-time great coaches.? But he?s definitely not the guy to be selling the NFL to a potential customer base that has to date been as ambivalent as Belichick is when meeting with the media.

The Dunphys decided to tone down the Halloween decorations this year because last year apparently they were too scary for kids (and one adult). Claire was pretty proud of herself until Phil told her she wasn?t that scary.

Lily wants to dress like a princess for Halloween again this year and Mitch admits that he accidentally told Lily her mother was a princess in a far away land. In his defense he was really tired and thought she would forget. Now he has to tell Cam why she is obsessed with Princesses and he isn?t looking forward to it.

Claire dresses up like Little Bo Peep and waits for kids to come trick or treating but they are avoiding her house. She tries to go outside and pass out candy but she hooks a little girl with her cane and she screams. Now the neighbors are really afraid to go to their house.MODERN FAMILY - "Open House of Horrors"

After accidentally pulling the fire alarm with his umbrella at school, Manny went to the principal?s office. Gloria was furious with the principal when she found out and threatened to go to his house. Manny told her to calm down because the pregnancy is making her a ?hot head.? That didn?t go over well. Later two older kids (not wearing costumes) tried to trick or treat at her house and she took their candy after they told her she was too old to be having a baby. They egged her house and she ran screaming after them ?You put egg on my house, I kill what you love!? Spoken like a true hot head.

Phil is at his open house and there aren?t too many people stopping by. Claire decides since they have been shunned by the neighborhood she would go show Phil just how scary she can be. Phil knew she was in the house but couldn?t find her before a couple came to look at the house. Phil was afraid to show the house because he didn?t know what Claire was up to. After the couple left, the lights went out and the TV turned on by itself and leaves were rustling outside. Phil thought it was Claire until she called him and told him she was at home with the kids. Now Phil is really freaked out and went upstairs where Alex grabbed his leg from under the bed, Luke jumped out of the closet and Claire popped up from the bed and he screamed! Hilarious! They got him good!

MODERN FAMILY - "Open House of Horrors"Mitch and Cam had a Halloween party and Cam wants to show off his new body (since he lost about 30 pounds) but after a costume mix up and someone else showing up to the party who lost 100 pounds, Cam is not happy about the lack of recognition. Lily is talking to a woman who was dressed like a Princess and tells her that her mom is a princess too. Cam overheard and Mitch had some explaining to do. He confessed that he told Lily her Mom was a princess and they decided to tell her the truth about how they became a loving family. Lily took it well and decided to ditch the princess costume and dress up like her daddy for Halloween. It was so cute! ?Jay told Cam he looked great and he could tell he lost weight and that made Cam?s night. The party ended up being a success after all!

Mellody Hobson Replaces Roger Enrico as Chairman of ...

Roger Enrico?has resigned as chairman of DreamWorks Animation and is being replaced by board member Mellody Hobson, the company announced Thursday.

Enrico, the former CEO of Pepsi, had been the chairman of DreamWorks Animation since 2004. No reason was given why Enrico, 67, is stepping down.

Hobson, 43, is president of Chicago-based Ariel Investments, which manages more than $3 billion in assets, and chairwoman of Ariel Mutual Funds. Ariel is reportedly among the largest African American-owned money management and mutual fund companies in the U.S.

Hobson regularly contributes commentary on financial issues on ABC?s Good Morning America and is a spokesperson for the annual Ariel/Schwab Black Investor Survey.

In 2009, Hobson hosted a show on ABC called Unbroke: What You Need to Know About Money, which was meant to educate people about how to invest and save money. It featured appearances by celebrities including Samuel L. Jackson, the Jonas Brothers and the Muppet character Oscar the Grouch.

Olympic medals 'stolen' as athletes party at nightclub

Rower Alex Partridge was one of two of British Olympic medal winners who had their medals stolen on Wednesday.

Updated at 11:22 a.m. ET: LONDON -- Two British Olympians said Wednesday that?their medals were stolen?-- and they've turned to social media in an attempt to get them back.

British rower Alex Partridge and field hockey player Hannah Macleod said their 2012 Olympic bronze medals, along with Partridge?s "Team GB" blazer, disappeared early Wednesday at an upmarket London nightclub. They were among a group of athletes who went to the club?after attending a royal reception at Buckingham Palace to celebrate the British team's success at the 2012 Games.

Under the Twitter name @2012parters, Partridge, 31,?posted a CCTV image with the tweet: ?Does anyone recognize this man as he may be able to help me get my @London2012 bronze medal and @TeamGB blazer back.?


Macleod, 28, tweeted:??My medal was also stolen at the same time. Totally devestated (sic).??

In an interview Wednesday night on BBC Radio 5 Live,?Partridge said he initially thought his possessions had been mistakenly taken by another team member. But after looking at a CCTV recording, he said that doesn't appear to be the case.

?Someone?s taken my Olympic blazer with my Olympic bronze medal in it and all I want is to get them both back," Partridge said.

"I'm not after punishment," British Olympic hockey player Hannah Macleod said on Twitter after her medal went missing at a London nightclub.

The full impact of the incident only hit him when he got home, he said.??I suddenly realized my daughter would never see this medal -- what I?d worked so hard for, for 12 years.?

Police?issued an appeal for information into the alleged theft and said the missing jacket, but neither of the medals, had been handed into police Thursday morning.

Cutting my own hair. I've done it since 1980 and I have saved countless hours and thousands of dollars. The downside is you end up with ridiculous looking hair like mine.

Typical day is 530 to about 3?5. Granted once in the office not a whole lot goes on exactly. Depends on the day.

Why am I so tired? I hate being tired and dragging. It is not all the time though. What can I be drinking(I drink good amount of water) eating or taking to help me?

I also lack motivation a lot to do stuff once I?m off work. Suggestions?

When you say no sugar do you mean at all, because sugars that are found in fresh fruits or fruit juices should help a fair bit.

Eat healthy foods, lots of fruits and vegetables, drink lots of water, get enough exercise and enough sleep. It sounds like you might not be getting enough exercise and sleep.

Try getting out at lunch time and taking a walk. Also, like someone else said, drink some fruit juice or eat some fruit for natural sugar(s).

7 killed in shootout with marines in Mexico

Mexican authorities say seven people, including two women, have been killed in a shootout with marines in the northern state of Zacatecas, a Zetas cartel stronghold.

A spokesman for the state's prosecutors says the marines arrived at a safe house just outside the city of Zacatecas early Tuesday when they were attacked by an armed group. Jorge Flores says the shooting lasted two hours.

The seven alleged criminals killed have not been identified.

The Mexican Navy said it has no information on the shootout.

The state of Zacatecas appears to have been a hot spot in the falling out between the leaders of the brutal Zetas gang. One of them, Heriberto Lazcano, was killed two weeks ago by marines in the neighboring state of Coahuila. Miguel Angel Trevino remains a fugitive.

Sony PlayStation Portable really refuses to die as japanese developers are continuing work on projects for Sony?s first handheld and some companies like Atlus and Xseed ?are continuing to support the system in the west with localizations of older japanese titles and PSN only releases.
Last year XSeed announced the acquisition of the rights for the japanese Survival Horror ? Rpg hybrid Corpse Party.
The history of The Corpse Party franchise is a peculiar one: starting as a ?dojin game? ( games created by japanese hobbyists), the first game in the series was developed using the RPG Maker software and released in 1996.
The game was remade and released again for Windows Personal Computers in 2008, for PSP in 2010 and iOS devices this February. A sequel was released in Japan on PSP last year.?There are also four manga adaptions, published by Square-Enix, Media Factory and Mag Garden.

The first Corpse Party game is a linear survival horror adventure with some light RPG elements: players control a party of one to 5 characters, exploring a haunted school ground, interacting with non playable characters, picking up items and?solving the mystery behind the cursed school.?Unlike most survival horrors character can?t be physically harmed and it?s going to be the events around them that will shape their destiny within the game.?The first game has been praised for his good narrative and replayability.?The games sports a system called ?Wrong Endings?, activated when the player performs actions that are irrelevant to the ultimate goal: as the story unfolds, more wrong endings are possible.

Today XSeed announcent the localization of the sequel of the first Corpse Party Game. Released last year in japan, Corpse Party: Book Of Shadows features a slightly different gameplay experience: gone is the top down view?in favor of a point and click interface. For the rest we can expect the usual combination of mystery, tension and horror and a compelling plot.

XSeed hasn?t given an exact release date: the aim is for a 2012 release on PSN. No word yet on PSVita Compatibility.

Almost every employee has heard this mantra: We need to work as a team!

Team building is probably one of the most requested organizational development activities in business today, but like most things, with popularity comes saturation.

There are a lot of tools and techniques available to help teams learn to function better together. But the challenge is they aren?t all created equal and many of them require significant investment.?

As an organizational psychologist, I tend to take a pretty simplistic view of team building. To tweak a phrase from the world of real estate, it all comes down to communication, communication, communication.

When facilitating team communication, there are two core activities any manager or executive should focus on: building trust and generating dialogue. ????

Building Trust

Ralph Waldo Emerson once said, ?trust men and they will be true to you; treat them greatly and they will show themselves great.? Just as most collaborative efforts, the development of trust is a two-way street. When it comes to building a high-performing team, it?s no different.? ?

Business professor Stephen Robbins defines trust as ?a positive expectation that another will not ? through words, actions, or decisions ? act opportunistically.? Integral to this definition is the fact that perceptions about what is opportunistic will differ between individuals. Building trust isn?t just about telling the truth, it?s about creating familiarity and developing a willingness to take risk. This begins with facilitating a conversation about trust among team members.

One model of trust that is useful for facilitating conversations comes from Schindler & Thomas (1993) and is comprised of five elements:

  • Integrity ? honesty and truth
  • Competence ? technical and interpersonal knowledge
  • Consistency ? reliability and predictability
  • Loyalty ? willingness to protect and/or sacrifice personal gain for that of the team
  • Openness ? ability to give and receive critical feedback

Trust is more than just honesty, it?s also about knowledge and appreciation for others. In order for open and free communication to flourish, you must cultivate a feeling of trust at multiple levels across the team.???

Generating Dialogue

Stephen Covey, author of The 7 Habits of Highly Effective People, once said, ?When the trust account is high, communication is easy, instant, and effective.? Communication is about taking risk, which is why it?s important to come from a foundation of trust.

Generating dialogue can be tough. In any communication opinions will vary and emotions will run strong. Broaching a tough subject is never easy and always requires some risk. This is why it?s typically easy to just avoid confronting tough subjects. However, just like an untended wound, unspoken concerns will fester, ultimately creating more issues than necessary. ?

An excellent model for teaching teams to conduct conversations is the STATE model from the book Crucial Conversations (Patterson et al., 2001). ??

  • Share facts
  • Tell a story
  • Ask for their side
  • Talk tentatively
  • Encourage testing

Tough or crucial conversations are scary, awkward and stressful. But when done right they can be informative, transformative, and even empowering. Never be afraid to get things out in the open. The STATE model is a great way to manage and control tough and emotional conversations among team members. ?

All too often we spend our time rushing toward an undefined finish line while ignoring what?s going on around us. At the end of the day, team synergy is rooted in trust and open dialogue. Take the time to extract your team for the mayhem of everyday work and explore these two aspects of team synergy.

Spanish homeowners dealing with fires and floods will have to pay

??Expats whose homes were destroyed by recent floods and fires will likely not receive financial support

EXPATS claiming for damage caused by the recent fires and floods are being warned they may have to foot much of the bill themselves.

This comes despite the government setting up a dedicated fund to help the thousands affected by some of the worst natural disasters to hit Andalucia in decades.

Many are likely to miss out because they fail to meet the strict criteria imposed by the government because their homes are not correctly registered, claims a leading expat insurance broker.

?The government is promising the world, but in reality many people will not be entitled to any help,? said Jacqui Caplen, from the Insurance Centre, in Coin.

She revealed that owners, whose homes are not classed as legal will not be entitled to a penny, while even homeowners who are fully-insured face a lengthy battle to claim compensation.

It comes as most insurance firms are not required to pay out because the floods and fires are considered ?acts of God?.

?It means all those affected must apply through the Spanish Insurance Consortium, which handles natural disaster claims,? continued Caplen.

The consortium is a fund set up by the government into which all insurance companies pay a set annual premium.

It is different to the emergency fund which was set up by the government immediately after the events to help people who are not insured.

?For those that are insured a lot of people assume that their insurance company will sort out their claim, but they don?t realise this is something they must do themselves,? continued Caplen.

?It can be a long and complicated process and they will probably need to seek independent advice, perhaps from a lawyer.

?It is heartbreaking to see the effects these things have on peoples lives and it is a shame they are not better informed about the claims process in the first place.?

Perversion of the rule of law in Timor-Leste and its impact on State ...

ETLJB 21 October 2012 - The rule of law is an indispensable concept of democracy. Without it, democracy is destroyed and a state based on the will of those who wield political, social and economic power emerges, to the great detriment of the masses who are then subject to? the arbitrary self-interests of the powerful no longer accountable under the law.

During the Indonesian occupation, which was essentially an illegal military occupation, there was, as there are in all states of martial law, a displacement of the rule of law by the rule of state violence. Uncountable violations of the municipal criminal (and civil) law, innumerable violations of the most basic of human rights, the right to life, the right to a fair trial, the right to freedom of peaceful assembly, among others, were and remain, unpunished. Impunity for criminal acts perpetrated by the Indonesian military and police as well as those Timorese themselves who participated in them either willingly or under duress during the 24-year occupation was the order of the day.

In the years since the restoration of independence, there has emerged a pattern of impunity and the arbitrary overriding of the judicial organs of state by the executive along with a growing disconnect between the citizenry and the state and those who occupy and control the state apparatus. This disconnect has recently been articulated and analysed by Neve in his article Legitimate Politics and Structural issues in Timor?s Fragility.

I posit that a central element of this disconnect and the erosion of the rule of law and democratic principles, and, therefore, of the problem of legitimacy of the state in East Timor, is this pattern of impunity for serious crimes as well as the partial application of the law based upon social or political status.

As pointed out in a recent article by Fundasaun Mahein (FM), ?the matter of justice and impunity for crimes is not just a matter that complicates the relationship between Indonesians and Timorese, but increasingly it is a matter of concern for relations between Timorese and other Timorese, inside Timor-Leste.?

Since the restoration of independence, there have been several prominent circumstances of serious criminal behaviour in respect of which the perpetrators have not been subject the full force of the law or, where they have been found guilty by the Courts and subjected to the penalties provided for in the criminal laws which they violated, have been released by the Executive from their legal liability to serve those penalties. All of those circumstances have undermined and dealt debilitating blows to the rule of law and the separation of powers doctrine that form the pillars of a democratic state.

FM cites several ?security incidents? that have occurred in East Timor since independence that have resulted in manifestations of impunity; they being:

Furthermore, says FM, there has ?a trend that sees important people not having to pay the penalty for their actions.? A number of politicians and their relatives have been involved in fatal vehicle accidents since 2004 but have never had to follow the law.?

Behind this impunity and exemptions from the application of the law by blind justice, is, according to FM, the ?socio- economic hierarchy [that] drives the decisions behind how and when the legal rules will be bent in order to maintain harmonious relations or to ?protect? people from the law.?

FM cites the following cases as examples of this trend:

1.????? The case of F-FDTL (East Timor Armed Forces) solider Armindo da Silva convicted in killing PNTL officers on 25 May 2006 at the terrible height of the 2006 disintegration of the rule of law. This soldier only spent some time under ?house arrest? and was then forced to retire from the army.? However the army ensured that his retirement was effected in an honourable manner so as to protect his reputation.? This was because he was veteran of the 24-year armed struggle in FALINTIL and a close associate of the senior F-FDTL leadership despite his relatively low rank.

However, Lucia Lobato comes from a senior and important political family in Timor-Leste and she is the niece of the first Commander of FALINTIL and the second President of Timor-Leste Nicolau Lobato.? As such, imprisoning her for the 5 years that she was sentenced to is proving politically difficult and she continues to walk free to the present.? Interestingly, her husband has also been convicted of company embezzlement and is also at large. Her appeal to the Court of Appeal is still pending some 4 months since the initial conviction. The Court of Appeal continues to say that it must study the appeal.

3.????? Other examples are that a number of high level former soldiers, armed civilians, and the PNTL officers actively engaged in the violence of 2006/2007 have become members of Parliament, senior civil servants, Ministers, and business people.? For some ? crime has been good business and highly profitable.

ETLJB would also like to highlight the following further cases of impunity and/or lenient application of the law based on the status of the accused or convicted person:

?The evidence relating to the unlawful movement, possession and use of F-FDTL weapons is described in paragraphs 95 and 96 and demonstrates that those weapons were distributed by and/or with the knowledge and approval of the following persons: Roque Rodrigues, Taur Matan Ruak, Tito da Costa Cristovao, aka Lere Anan Timor, Manuel Freitas, aka Mau Buti, and Domingos Raul, aka Rate Laek Falur. The Commission recommends that these persons be prosecuted for illegal weapons transfer.?

At least 36 people were killed in the 2006 violence. None of the gentlemen referred to in the UN Report were ever prosecuted and, as FM, points out, some have come to occupy significant positions in the state apparatus. For example, Lere Anan Timor replaced Taur Matan Ruak as Commander of the East Timor Defence Force after Taur resigned his commission to run for the presidency to which he was elected.

Rogerio Lobato, former Minister for the Interior under the I Constitutional Government and a relative of Lucia Lobato also enjoying the same familial connections, was pardoned by the then President Jose Ramos Horta after beingsentenced to jail for criminal violations after the armed Rai Los group claimed he was the one responsible for the distribution of weapons to civilians in the 2006 crisis. The pardoning of criminals by the President was criticised by the Judicial System Monitoring Program and the issue of presidential pardons and how the president exercises his constitutional prerogative to pardon and give amnesties remains unsettled. In June 2008, prominent citizens presented a petition to the Court of Appeal seeking a declaration that other pardons granted by the President were unconstitutional. ETLJB has also published a critique of the pardon process as it has been exercised to date and its impact on the rule of law (see further The Rule of Law in East Timor: Death by a Thousand Cuts). Pardons for serious crimes undermine the rule of law because it subverts the judicial process. Pardons, as well as the impunity (lack of prosecution) for the perpetrators of crimes, also impact on the legitimacy of the state that claims to be democratic but which too frequently acts in violation of the fundamental principles of democracy. It would be an incredulous and profoundly disappointed community that would witness these phenomena and cause them to ask the questions, as Fundasaun Mahein poses:

What do our ancestors think of us? Do they smile with pride, or do they cry with shame? Is this what 200,000 of our fellow citizens died for?
